Terms of Service

AdvisorCompass LLC (“AdvisorCompass,” “we,” “us,” or “our”) provides Advisor Compass, a cloud-based CRM, intake, and client portal platform for senior placement, referral, and related care-coordination businesses (the “Service”). These Terms of Service (“Terms”) govern access to and use of the Service at https://app.advisorcompass.ai, Advisor Compass tenant subdomains, client portals, intake questionnaires, and related application features.
These Terms apply to the Advisor Compass application, not the public marketing website at advisorcompass.ai.
These Terms supplement, and do not replace, any signed order form, subscription agreement, Business Associate Agreement (“BAA”), or other written agreement between AdvisorCompass and a customer organization.
Definitions
Customer: The organization that purchases, activates, or is granted access to the Service.
Authorized User: An employee, contractor, advisor, or other person permitted by the Customer to use the Service through an account or role.
End User: A client, family member, provider, referral partner, or other person who uses a client portal, intake questionnaire, or messaging feature without being the Customer.
Customer Data: Information submitted to or collected through the Service on behalf of a Customer.
These Terms apply to Customers and Authorized Users. Certain provisions, including acceptable use, communications, privacy-related obligations, and intellectual property restrictions, also apply to End Users who access portals, questionnaires, or other Service features.
If you use the Service on behalf of a Customer, you represent that you have authority to bind that organization to these Terms.
Other Agreements and Fees
A Customer’s use of the Service may also be governed by an order form, subscription agreement, BAA, or other written agreement with AdvisorCompass. If there is a conflict, the BAA controls with respect to protected health information, the applicable order form or subscription agreement controls with respect to commercial terms, and these Terms control in all other respects.
Subscription fees, billing, renewal, and cancellation are set out in the Customer’s order form or other written agreement. If no such agreement exists, access may be provided under a separate arrangement.
The Service
Advisor Compass provides technology tools for CRM, intake, client portals, provider research, tasks, notes, documents, email, and related workflows. We may update, change, or discontinue features from time to time. Some features, including SMS/text messaging, may be enabled on a per-organization basis when available.
AdvisorCompass provides technology tools and does not act as a senior living advisor, referral agency, healthcare provider, attorney, financial advisor, fiduciary, or insurer. Customers and Authorized Users are responsible for their professional judgments, client communications, and compliance obligations.
License and Customer Data
Subject to these Terms, the applicable subscription or access arrangement, and payment of required fees, AdvisorCompass grants the Customer a limited, nonexclusive, nontransferable, non-sublicensable right during the subscription or access term to permit its Authorized Users to access and use the Service for the Customer’s internal business purposes.
Customers must not reverse engineer, resell, scrape, or use the Service to develop a competing product except as permitted by law.
As between AdvisorCompass and the Customer, the Customer retains its rights in Customer Data. The Customer grants AdvisorCompass and its service providers a limited right to host, copy, transmit, display, modify, and otherwise process Customer Data only as necessary to provide, secure, support, and operate the Service, comply with law, and perform our obligations under applicable agreements. Processing for Service operation does not include using Customer Data to train generalized AI models, as further described in our Privacy Policy.
The Service, including its software, design, branding, and documentation, is owned by AdvisorCompass or its licensors.
Customer Responsibilities
Customers are responsible for:
The accuracy and lawfulness of Customer Data and information entered by Authorized Users.
Configuring roles, permissions, and organizational settings appropriately.
Obtaining consents required before contacting clients, families, referral partners, or providers through the Service, including before sending email or SMS/text messages.
Their relationships with End Users whose information is stored in the Service.
Maintaining the confidentiality of login credentials and ensuring accounts are used only by the assigned individual.
Promptly notifying AdvisorCompass of suspected unauthorized access.
Ensuring former staff and contractors lose access promptly.
The Customer represents that it has all rights, permissions, notices, authorizations, and consents necessary for AdvisorCompass to process Customer Data as contemplated by these Terms, the Privacy Policy, and the Customer’s other agreements with AdvisorCompass.
AdvisorCompass processes information as described in our Privacy Policy.
Acceptable Use
You agree not to misuse the Service. Without limitation, you must not use the Service in violation of law or third-party rights, send unlawful or deceptive bulk messages, interfere with Service security or availability, or attempt unauthorized access.
We may suspend or restrict access if we reasonably believe these Terms or applicable law have been violated.
SMS and Text Messaging
When SMS features are enabled for a Customer organization, Authorized Users may send case-related text messages on behalf of that organization.
Messages are sent by or on behalf of the Customer organization identified in the message. AdvisorCompass provides transmission technology but does not independently choose recipients or message content. Messages should reasonably identify the Customer organization.
Recipients provide consent directly to the Customer organization whose advisor is messaging them. Consent is specific to that Customer's case-related messaging program. We do not sell, rent, or share mobile phone numbers or SMS opt-in/consent data with third parties or affiliates for marketing or promotional purposes.
Opt-in: Recipients must opt in before receiving SMS messages. Supported methods include intake or questionnaire consent, or documentation that the recipient previously consented directly to the Customer. Recording consent in the Service does not itself create consent. The Customer must obtain, document, and maintain legally sufficient consent and make evidence available when required. Consent is not a condition of receiving services. Consent to receive SMS messages is not transferable and does not apply to other brands or affiliates.
Frequency and rates: Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
Opt-out: Recipients may opt out by replying STOP, or by any other reasonable method. Customers must promptly honor opt-out requests received outside automated SMS workflows. After a valid opt-out, no further SMS messages will be sent to that number through the program unless the recipient later provides valid consent to resume.

We may suspend SMS features if we reasonably believe messages lack valid consent or violate these Terms.
Email and Newsletters
Customers and Authorized Users control email and newsletter content sent through the Service. Customers are responsible for accurate sender information, nondeceptive subject lines, required identification and physical address in commercial email, and a functioning unsubscribe method where applicable.
For newsletter sends through the Service, AdvisorCompass provides unsubscribe links and suppression-list mechanics. Customers remain responsible for list compliance and honoring unsubscribe and suppression requests.
Third-Party Services
The Service may interoperate with third-party products and services such as email providers, SMS carriers, maps, hosting, AI, OCR, and transcription services. AdvisorCompass does not control third-party services, carrier networks, or third-party account restrictions. Use of a third-party service may be subject to that provider’s separate terms.
AI Features
Optional AI features may produce incomplete or inaccurate output. AI output is not medical, legal, financial, or professional advice. Authorized Users must review AI output before relying on it and must not use it as the sole basis for care, placement, or compliance decisions.
Disclaimers and Liability
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, AdvisorCompass will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the Service or these Terms. Our aggregate liability will not exceed the greater of fees paid by the Customer for the Service in the twelve months before the claim or one hundred U.S. dollars (US$100), except where applicable law requires otherwise.
Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms and update the “Last updated” date. If a change materially reduces a Customer’s rights or materially increases its obligations, we will provide reasonable advance notice through the Service, by email, or by another reasonable method. Changes apply prospectively from their effective date.
